1. Preamble

These Terms of Use (hereinafter "Terms") govern the access and use of the application Flots and the associated website https://flots.app (hereinafter "the Service").

The Service is published by the Flots team (hereinafter "the Editor"). For any questions, the Editor can be contacted via the contact form available on the website.

By creating an account or using the Service, you (hereinafter "the User") agree to these Terms without reservation. If you do not accept these conditions, you must not use the Service.

2. Access to Service and User Account

2.1. Account Creation

Access to Flots features requires the creation of an account. You warrant that the information provided during registration is accurate and up to date.

2.2. Security

You are responsible for maintaining the confidentiality of your login credentials. Any action performed via your account is deemed to be performed by you. In case of suspected hacking, you must inform us immediately via the contact form.

2.3. Legal Capacity

The Service is reserved for individuals capable of entering into contracts. Use by minors is the responsibility of their legal guardian.

3. Subscriptions and Payments

Full use of the Service may require a paid subscription.

  • Subscription: Subscriptions can be purchased directly via our website or via mobile applications (Apple App Store / Google Play Store).
  • Refunds: Our refund policy (including the 14-day "Money-Back Guarantee") is detailed on our dedicated page: Refund Policy.
  • Renewal: Unless cancelled before the end of the current period, the subscription is automatically renewed for an equivalent duration.

4. Intellectual Property

4.1. Editor's Property

All elements constituting the Service (source code, design, Flots logo, text, interfaces, structural databases) are the exclusive property of the Editor and are protected by intellectual property law. The User is granted only a personal, non-exclusive, and non-transferable license to use the Service. It is forbidden to copy, decompile, or reverse engineer the application.

4.2. User's Property (Your Data)

Your notes and tasks info belong to you. The User retains full intellectual property ownership of the content (text, images, files) created or imported into Flots. By using the Service, you simply grant the Editor a worldwide, royalty-free license necessary to host, backup, and display this content solely for the technical operation of the Service (so that you can access it on your devices).

5. User Obligations

By using Flots, you agree not to:

  • Use the Service for illegal purposes or to promote illegal activities.
  • Publish hateful, defamatory, obscene content or content infringing on the rights of others.
  • Attempt to disrupt the functioning of the Service (viruses, DDoS attacks, automated scraping).
  • Resell or rent access to your Flots account to third parties.

The Editor reserves the right to suspend or delete the account of any User who does not comply with these rules, without prior compensation.

6. Availability and Liability

6.1. Service Availability

The Editor strives to keep the Service accessible 24/7. However, access may be interrupted for technical maintenance or major problems. The Editor does not guarantee uninterrupted availability and cannot be held liable for the consequences of any unavailability.

6.2. Limitation of Liability

The Service is provided "as is". The Editor shall not be held liable for indirect damages suffered by the User (such as data loss, loss of profit, loss of business, or loss of opportunity) related to the use or inability to use the Service. To the fullest extent permitted by applicable law, the total liability of the Editor towards the User is limited to the amount paid by the User to use the Service during the last twelve (12) months.

7. Personal Data

The collection and processing of your personal data are governed by our Privacy Policy. We are committed to complying with the General Data Protection Regulation (GDPR).

8. Third-Party Links

The Service may contain links to partner or third-party websites. The Editor exercises no control over these sites and accepts no responsibility for their content or practices.

9. Changes to Terms

The Editor has the right to modify these Terms. Users will be informed of substantial changes. Continued use of the Service after modification constitutes acceptance of the new conditions.

10. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought in priority. Failing that, the dispute will be brought before the competent French courts.
